1. Seller Information

These Terms & Conditions are a legal agreement between you and James Khalil, the seller of CleanFit AI. By using our service, you agree to be bound by these terms.

2. Acceptance of Terms

By accessing or using CleanFit AI, you agree to these Terms & Conditions. If you do not agree, please do not use the service. Continued use of the service constitutes acceptance of any updates to these terms.

3. Product Description

CleanFit AI is an AI-powered photo enhancement tool designed for clothing resale listings. It provides background cleanup, lighting correction, and honest image enhancement while preserving the real condition of items. Outputs may vary based on input quality and content.

4. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated.

5. Acceptable Use

You agree not to misuse the service, including: unlawful use, fraud or spam, intellectual property infringement, interference with service security (including malware, probing, or scraping), and any activity that harms the service or other users.

6. Intellectual Property

James Khalil retains ownership of the CleanFit AI service, software, documentation, and branding. You are granted a limited, non-exclusive, non-transferable right to use the service within the limits of your selected plan.

You retain ownership of the images you upload. By uploading content, you grant us a limited license to host and process your images solely for the purpose of providing the service.

7. Payment, Subscriptions & Refunds

Payments are processed by Stripe. For eligible transactions, Stripe acts as the Merchant of Record and handles tax calculation, collection, and remittance on our behalf.

The Starter plan includes a 7-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial period and can cancel at any time before it ends to avoid being billed.

Subscriptions renew automatically unless cancelled. You may cancel at any time from your billing page; access continues until the end of the current billing period. Refunds are handled in accordance with our Refund Policy.

8. Service Level

We do not guarantee uninterrupted or error-free performance of the service. The service is provided "as is" to the fullest extent permitted by law. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

9. Limitation of Liability

James Khalil's aggregate liability is capped at the total fees you paid in the 12 months prior to the claim. We exclude liability for indirect, consequential, or special damages including loss of profits, data, or goodwill, except where prohibited by law.

10. Content Moderation & Takedown

We reserve the right to remove or restrict content, refuse outputs, or suspend accounts for misuse, illegal content, or repeated policy violations. We may take action against accounts that generate prohibited content including deepfakes, hate speech, or malware.

11. Termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. Upon termination, you may have a limited window to export your data before deletion.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which James Khalil operates, without regard to conflict of law principles.
